My question revolves around bad talking muslim (sunni and shia) convicted criminals and those who openly sin without visible remorse such as some Muslim celebrities (ex. rappers) that appear these days.

Would this fall under backbiting and what would be the conditions for repentance?

If they are openly committing sins, then it is permissible to backbite them in what they openly, rather than what they do not openly
